1. Prices & Quotations
All quotations provided by Siyara Trails are based on current tariffs, taxes, park / conservancy fees and supplier rates and are subject to availability at the time of confirmation.
Prices are quoted in United States Dollars (USD) unless otherwise stated and include statutory taxes where applicable.
While every effort is made to maintain quoted prices, Siyara Trails reserves the right to adjust rates in the event of:
- Government tax or levy increases;
- Changes to park fees or conservation levies;
- Fuel surcharges;
- Exchange rate fluctuations;
- Airline or supplier-imposed surcharges.
In such circumstances, any adjustment will be communicated promptly and explained in full.
2. Provisional and Booking Confirmation
All safari bookings must be requested in writing and are subject to availability. Please note that all reservations are held on a provisional basis until the required deposit has been received. A booking shall only be deemed confirmed upon receipt of written confirmation from Siyara Trails Team and payment of the required deposit.
- Unless a 20% deposit is received by the expiry date of the provisional booking, Siyara Trails reserves the right to release any rooms, accommodations, flights, permits, and other services held on the Client’s behalf without further notice.
All bookings are non-transferable and may not be assigned, resold, or transferred to another individual or booking without the prior written consent of Siyara Trails.
The Agent or Client is responsible for ensuring that all travellers are aware of and accept these Booking Terms & Conditions.
3. Payment Terms
Our payment terms are guided by the policies of our accommodation, transport and activity partners and may vary depending on the itinerary and destination. Unless otherwise stated, the following terms apply:
- A deposit of 20% of the total safari cost is required at the time of booking. The remaining balance is due 45 days prior to travel.
- Bookings made within 30 days of departure require full payment at the time of confirmation.
Gorilla / Chimpanzee Trekking Programmes
- Trekking permits require 100% non-refundable payment upon confirmation.
The balance is due 60 days prior to travel. Failure to make payments by the stated deadlines may result in cancellation of the booking and release of reserved services. In the event of a dispute, only the disputed amount may be withheld; all undisputed amounts remain payable in accordance with the agreed payment schedule.
4. Cancellation Policy
All cancellations must be made in writing and will take effect upon receipt by Siyara Trails.
The Cancellation Policy varies from supplier to supplier and your Siyara Trails Safari Planner will confirm the exact cancellation terms applicable to each booking. The effective date of cancellation shall be the date on which written notification is received by Siyara Trails. Unless otherwise advised in writing, the general cancellation terms outlined above shall apply.
- 120 – 61 days before travel: 20% of total safari cost
- 60 – 31 days before travel: 50% of total safari cost
- 30 days or less before travel: 100% of total safari cost
Please note that park permits, trekking permits and certain special activities may be non-refundable and subject to the terms imposed by the relevant authorities or suppliers.
4a. Group Cancellation Policy
The cancellation terms for group bookings may vary depending on the accommodation, airline, activity provider, or destination included in the itinerary. Your Siyara Trails Safari Planner will advise you of the specific cancellation terms applicable to your booking at the time of confirmation.
Please note that certain services, including but not limited to park permits, gorilla or chimpanzee trekking permits, charter flights, exclusive-use properties, and special events, may be subject to stricter cancellation terms and may be non-refundable from the time of confirmation.
Where a group booking is partially cancelled and the number of participants falls below the minimum group size required to qualify for group rates, Siyara Trails reserves the right to revise the rates, itinerary, and applicable terms accordingly.
5. Changes, Amendments & Refunds
Siyara Trails will make every reasonable effort to deliver the itinerary as confirmed. However, circumstances beyond our control may occasionally require changes to accommodation, transport, routes or activities. Where possible, equivalent alternatives will be arranged.
No refunds shall be due for unused services, missed activities, or changes necessitated by circumstances beyond Siyara Trails’ control, including but not limited to weather conditions, wildlife movements, airline disruptions or government regulations.
6. Travel Insurance
Comprehensive travel insurance is mandatory for all travelers.
Insurance should cover, at a minimum Medical expenses, Emergency evacuation, Trip cancellation or curtailment, Personal baggage and valuables, Travel delays.
Clients travelling without adequate insurance do so at their own risk. Siyara Trails strongly recommends arranging insurance immediately upon confirmation of the safari.
7. Passports, Visas & Health Requirements
It is the sole responsibility of the traveler to ensure that passports, visas, vaccinations and any other travel documentation required for the destinations visited are valid and obtained before travel.
Siyara Trails cannot be held responsible for any consequences arising from incomplete or invalid travel documentation.
8. Photography & Marketing
Siyara Trails may, from time to time, use photographs or videos taken during safaris for marketing and promotional purposes.
Should any guest prefer not to appear in such materials, they are requested to notify Siyara Trails in writing prior to travel.
9. Changes to Itineraries
While every effort is made to adhere to published itineraries, Siyara Trails reserves the right to alter routes, accommodations, transport arrangements or activities due to circumstances beyond our control, including but not limited to: Weather conditions, Wildlife movements, Road or airstrip conditions, Supplier availability, Government regulations or safety considerations.
Any such changes shall be made with the best interests, comfort and safety of our guests in mind.
10. Activities & Assumption of Risk
Safaris and adventure travel involve inherent risks, including but not limited to close proximity to wildlife, travel in remote areas, and participation in activities such as walking safaris, boating, deep sea fishing, diving, horseback riding, hot air ballooning and trekking – etc.
Participation in such activities is voluntary and at the traveler’s own risk. Guests are expected to follow the instructions of guides, camp managers and local operators at all times.
11. Liability
Siyara Trails acts as an intermediary between clients and independent suppliers such as airlines, lodges, camps, transport providers and activity operators.
While Siyara Trails undertakes due diligence in selecting reputable and reliable partners and ensure high standards of service and supplier compliance, Siyara Trails shall not be liable for:
- Delays, schedule changes, cancellations or disruptions caused by third parties; Injury, illness, overbooking, loss or damage suffered during the safari beyond the limits imposed by applicable law.
- Loss arising from force majeure events including natural disasters, pandemics, political unrest, war, strikes, acts of God or any other event beyond our reasonable control.
By confirming a booking, the Client acknowledges and accepts the risks associated with safari travel and agrees to release Siyara Trails, its employees, agents and suppliers from liability to the fullest extent permitted by law.
In the event of service delays, cancellations, or overbooking, Siyara Trails and its local partners will make every reasonable effort to assist Clients in securing alternative arrangements or minimising inconvenience. Such assistance is provided as a courtesy and does not constitute an acceptance of liability for any resulting costs, losses, damages, or expenses incurred by the Client.
12. Governing Law
These Terms & Conditions shall be governed and construed in accordance with the laws of the Republic of Kenya, and any disputes arising shall be subject to the exclusive jurisdiction of the Kenyan courts.
